Welcome to the terms and conditions page of Nomad Excursion (the “Company”, “we”, “us”, or “our”). By accessing or using our website, nomadexcursion.com (the “Site”), and/or booking a tour or service offered by the Company (the “Tour”), you agree to be bound by the following terms and conditions (the “Terms”).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE OR BOOKING A TOUR.
1. Eligibility
The Site and the Tours are intended solely for persons who are 18 or older. Any use of the Site or the Tours is void where prohibited. By using the Site or booking a Tour, you represent and warrant that you are 18 or older and that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.
2. Modification of the Terms
We reserve the right to modify these Terms at any time. Any modifications will be effective upon posting on the Site. You are responsible for regularly reviewing the Terms. Your continued use of the Site or booking of a Tour after any such modifications constitutes your acceptance of the modified Terms.
3. Site and Tour Availability
We reserve the right to change, suspend, or discontinue the Site or any Tour, in whole or in part, at any time without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Site or any Tour.
4. Tour Prices and Payment
All Tour prices are quoted in Moroccan Dirhams (MAD) or (USD) and are per person unless otherwise specified. Tour prices are based on the current costs of operation, including fuel and other related expenses. We reserve the right to change Tour prices at any time without notice.
Full payment for the Tour must be received by the Company at the time of booking. We accept payment by credit card (Visa and Mastercard) or bank transfer. A processing fee may apply for credit card payments.
5. Cancellation and Refund Policy
Cancellations must be made in writing and sent to the Company by email at [email protected]. The following cancellation fees will apply:
- Cancellations made more than 14 days prior to the Tour start date: full refund minus a 10% processing fee.
- Cancellations made between 7 and 14 days prior to the Tour start date: 50% refund.
- Cancellations made less than 7 days prior to the Tour start date: no refund.
We reserve the right to cancel a Tour at any time for any reason. If we cancel a Tour, you will be entitled to a full refund.
6. Tour Changes and Itineraries
We reserve the right to make changes to Tour itineraries as necessary. We will make reasonable efforts to notify you of any significant changes to the Tour itinerary.
We will not be responsible for any expenses or damages resulting from changes to the Tour itinerary, including but not limited to missed flights, missed connections, and other travel arrangements.
7. Tour Participation
You must follow the instructions and directions of the Tour guide at all times. The Tour guide has the right to disqualify any participant from the Tour who is disruptive, poses a safety risk to themselves or others, or otherwise fails to follow the instructions and directions of the Tour guide. If you are disqualified from the Tour, you will not be entitled to a refund.
You are responsible for your own safety and the safety of your personal belongings during the Tour. The Company will not be liable for any loss, damage, or injury that you may incur during the Tour.
8. Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for any loss, damage, or injury that you may incur as a result of participating in the Tour.
This includes, but is not limited to, loss, damage, or injury resulting from the act or omission of any third party, including but not limited to other Tour participants, Tour guides, and service providers.
9. Governing Law and Dispute Resolution
These Terms and your use of the Site and the Tours shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without giving effect to any principles of conflicts of law.
Any dispute arising out of or relating to these Terms, the Site, or the Tours shall be resolved through binding arbitration in accordance with the Rules of Conciliation and Arbitration of the International Chamber of Commerce. The arbitration shall be conducted in Marrakech, Morocco. The language of the arbitration shall be English.
10. Miscellaneous
These Terms constitute the entire agreement between you and the Company regarding the use of the Site and the Tours. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not transfer any of your rights or obligations under these Terms without the prior written consent of the Company. The Company may transfer its rights and obligations under these Terms without your consent.
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and the Company.
Any rights not expressly granted in these Terms are reserved by the Company.
